The purpose of the Indiana Department of Insurance is to protect Hoosiers as they purchase and use insurance products to keep their assets and their families from loss or harm. Consumers may need assistance with certain claim situations or just help in understanding how their policies work. Our other primary obligation is to monitor the financial solvency of the insurance companies domiciled in Indiana so that the legal promises made in insurance policies are honored. Staff Attorney

The Indiana Department of Insurance is looking for a Staff Attorney. The Staff Attorney provides legal advice regarding insurance regulation to the Department and to the Commissioner in his/her role as administrator of the Patient’s Compensation Fund (PCF) under the Medical Malpractice Act. The position is responsible for performing analysis for the attorneys in the Legal Division, including review of discovery submitted to the Patient’s Compensation Fund (PCF). This person will also assist in the procurement and contract process and advise department personnel regarding public records requests.

A day in the life

  • Research and analyze legal issues to advise department personnel on compliance with Title 27 (Insurance Act) of the Indiana Code;
  • Review financial transaction approval requests submitted by insurance companies for compliance with insurance law and make recommendations for future action, if necessary;
  • Serve as the final reviewer for insurance holding company filings of material transactions for domestic companies required to be reviewed by the IDOI per IC 27-1-23;
  • Serve as primary internal counsel for the Financial Division;
  • Provide legal advice regarding company supervisions, rehabilitiations, and insolvencies.
  • Represent the Commissioner as Administrator of the Indiana Patient’s Compensation Fund by:
  • Reviewing discovery, drafting correspondence, performing depositions, etc., under the supervision of the Deputy General Counsel;
  • Evaluating medical malpractice claims presented to the Patient’s Compensation Fund, including corresponding and negotiating with plaintiffs’ attorneys; preparing pleadings and motions; conducting discovery; deposing witnesses; and appearing at damages hearings, motion hearings, conferences, etc.;
  • Attending mediations, exhibiting knowledge of the facts of the case, medical issues, and applicable legal issues;
  • Considering the interests of Medicare when resolving PCF claims, including determining if a Medicare Set-Aside Account should be established; and
  • Assisting in the completion of all necessary end-of-quarter reporting, including actuary spreadsheet, payments spreadsheet for annual report, system update spreadsheet, and NPDB reports;
  • Respond to questions from other state agencies, legislative services agency, the public and the insurance industry regarding Indiana insurance laws, regulations and bulletins.
  • Assist all areas of the Department on professional services contracting, including procurement (RFP, sole source, other), contract negotiation, and the approval process;
  • Oversee public records requests received by the Department to ensure compliance with Indiana’s Access to Public Records Act;
  • Speak to consumer and industry groups about insurance issues; and
  • Complete projects as assigned by general counsel, deputy general counsel, and chief of staff

What we’re looking for

  • Graduate degree in law and admission to Indiana State Bar;
  • Experience in the legal field;
  • Ability to interpret and apply state and federal laws, rules, and regulations;
  • Ability to communicate effectively verbally and in writing;
  • Organizational ability to formulate and carry out case litigation’s and initiate policies;
  • Presentational skills with ability to persuade;
  • Thorough knowledge of and ability to apply all requirements established by governing bodies;
  • Ability to research and evaluate legal precedents;
  • Participation in continuing legal education programs;
  • Ability to apply legal principles;
  • Ability to analyze complex problems and make sound resolutions of problems;
  • Ability to tactfully communicate with a wide variety of administrators and involved officials to resolve disputed problems;
  • Basic keyboarding skills and experience in Microsoft Outlook, Word, and Excel.
